Terms and Conditions

With Digital Hammerr, you will receive professional, timely, and friendly service. These terms and conditions will apply to clients who engage Digital Hammerr with their business:

The Contract

  • A relationship of independent contractors will be established between Digital Hammerr and its clients, and neither party intends or implies a joint venture.
  • Both parties will agree on a start date for the services, and charges will be applied accordingly.
  • We will provide clients with a monthly performance report.
  • A prior notice of at least 10 business days is required before either party can cancel or fully transfer service responsibilities to another vendor.
  • Some service tasks may be subcontracted to a third party service provider by Digital Hammerr.
  • The Contract does not grant any rights to anyone who is not a party to it.
 

Payment

  • Whenever clients avail any monthly service package of Digital Hammerr, they are required to pay the full chargeable amount prior to the start of the work.
  • Any fixed quote agreed upon between Digital Hammerr and the client is subject to 50% of the billable amount being paid in advance before any work can begin. Upon the start date of the services, the remaining 50% must be paid within 7 days.
  • Invoices will be issued by Digital Hammerr to clients on a monthly basis, in advance.
  • The client’s services will also be terminated immediately if the invoice is not paid as agreed. A 10-day notice will not be required in this case.
 

Liability

  • When natural or ungovernable causes cause a delay in obligated service deliverables, Digital Hammerr shall not be liable for indirect or consequential losses.
  • In this agreement, the client will defend, cover, and hold harmless Digital Hammerr from all claims, losses, liabilities, and expenses related to Digital Hammerr’s services provided to the client, including claims made by third parties alleging false advertising, legal responsibility for products or services sold by the client, intellectual property infringement, claims related to disruptions or malfunctions of the services provided, or for any content you provide for publication by Digital Hammerr.
  • When the publication of the content/information is completed, the public will be able to access the content/information provided by the clients to Digital Hammerr. It is not the responsibility of Digital Hammerr to screen the material or to replace or replace any business asset, goodwill, or profit that is lost due to the nature of the content being publicized.

Waiver

  • At any time during the term of a service contract, if we fail to insist that you strictly comply with any of the obligations contained in these terms and conditions, this will not automatically relieve you of your obligations.
  • Waivers of terms and conditions must be in writing and communicated to you.

Privacy Rights

For any kind of money transaction, we use SSL encryption technology to ensure maximum protection against online theft and fraud.

  • By filling out the contact form, clients provide us with information such as their name, email, contact number, website URL, which is kept confidential and will never be disclosed to a third party without their consent. Digital Hammerr employees will have access to the information.
  • The information you provide will be protected by Digital Hammerr using reasonable security measures.
  • Any kind of security in regards to data transfer over the internet cannot be guaranteed by Digital Hammerr.
  •  used to track the browsing information/preferences of web users and we may use Cookies to gather statistical data about your browsing pattern for optimizing our site.
  • You may also receive statistical information about yourself from third-party advertisers who advertise on our website. Neither we nor third parties have access to any of your personal information through Cookies.

We reserve the right to modify the above terms and conditions at any time, including during an ongoing contract, and will notify clients through our company email if changes are made.
